A senior policewoman who was caught speeding well over the specified speed linit is challenging the charge by claiming the speed gun used by her own force to catch her was not accurate.
The controversial camera, which has been described as on of the most lucrative in Britain, has captured on average 1,843 motorists per month. And with the average fine for speeding 60, that equates to 1,327,140 each year.
One of the largest criticisms of fixed cameras is their placement and visibility to motorists. Many forward facing cameras are purposefully placed behind large street signs, trees or walls to avoid being spotted by motorists until they are in its range.
If the case is won, the floodgates could open to thousands of motorists to appeal their own speeding tickets across the country who have been caught using the devices.
Motoring groups feared the camera was converted to in a move to 'milk the motorist' as the speed limit is also said to be to low for a dual carriageway.
A driver can be fined when caught speeding by a mobile camera but if they have no proof the camera was placed illegally; they have no claim to malpractice. Many activists have begun photographing mobile cameras to prove they are acting illegally, many websites offer thousands of images of camera vans parked on pavements with double yellow lines, hidden around bends, in the way of pedestrians and blocking entrances to properties.
Another technicality has been brought to light that since 1992, none of the 6000 speed cameras set up have had acquired the necessary parliamentary approval after a change in legislation.
The trial will be in October at Nottingham Magistrates' Court.
