An attorney labeled as unconstitutional the state system for compensating lawyers forced to represent indigent clients and he demanded the state supreme court abolish it and devise a new system which is fair to urban and rural lawyers alike. According to this lawyer, requiring attorney to pay for the defense services of these citizens who cannot afford these services is really unfair. The reactions and queries of the justices in the court showed that he definitely got their attention and sympathy.
Compensation is definitely a problem in rural areas where public defenders' offices are nil and there are hardly any lawyers available. Assigning cases to lawyers and setting up indigent defense systems are suddenly forced onto judges as responsibilities. Those criminals who come from indigenous backgrounds should be provided a fair trial and defense by the state.
Can lawyers have rights found in the constitution as well? Lawyers are the only group of people in the United States who are mandated by the state to donate their time and wealth to the poor without receiving enough compensation. If lawyers have to pay to provide services for the poor, then doctors, plumbers, and architects should do the same.
Attorneys must fulfill their moral and ethical duty to represent a client regardless of the amount of compensation he might receive. There is no provision in the constitution that the state should pay attorneys for public defender work. Providing public representation is a moral and ethical obligation of those involved in the legal profession in Kansas.
Running out of money is a risk lawyers put themselves in by defending indigent clients. Under the law, attorneys are obligated to take indigent cases, though I am sympathetic about the compensation problem. Profiting from representing indigent clients is not a constitutional right of an attorney.
According to one attorney, this obligation to help the poor is fine just so long as it doesn't create a grave financial situation for himself. One justice questioned why the rate paid private attorneys to represent indigents was arbitrarily cut from $30 per hour to $26 when the state faced a recent fiscal crisis, yet no cuts were made on the budgets public defenders' offices.
Attorneys under the federal system provided legal representation to their clients without any compensation, just like the current situation of the state, the justice said. A federal public defenders' system is now active.
Inadequate legal representation for criminals is not in accordance to their constitutional right, and yet may happen because attorneys are made to spend their own money for the legal services of the criminals. This keeps the defendants from getting their constitutional right to a fair trial.
Having a client to represent was once called an honor. Then, it wasn't just free legal counsel simply for felonies but for other things as well. The system is bound to fail. From time to time, I would like to do certain work for free. The situation has gone way off.
