When you receive a notice to the effect that foreclosure proceedings are starting, you can't afford to waste any time responding.
Even though you may be feeling fear or panic at the prospect of losing your home, you need to force yourself to act right away. Every day that passes once you receive the foreclosure notice is a day closer to losing your home, so take action right away.
Time is limited so this is what you should do.
1. Contact your mortgage holder and arrange a face to face meeting with someone who has authority to make decisions. Don't discuss anything on the phone. When you have your meeting, be prepared to supply facts and figures to the loan officer. They will want to know if you are employed or not, how much you make, assets, and current expenses.
They at least owe you the courtesy of discussing possible options. If you show that you have some resources available, you may be able to arrange a modified loan. The loan could be in the form of an interest only payment for a specific period of time. It may be a lengthening of the term of your mortgage, or a reduction on the rate of interest. Any of these alternatives can make a huge difference in your payments making them affordable.
2. If there is any equity in your home, you could possibly exchange this equity to clear up enough cash to bring your mortgage out of arrears. At the same time, it will be important to setup a new mortgage with terms that will make your payments within your means.
3. You may be able to get a one time payment from the FHA Insurance fund to bring your mortgage up to date. You may qualify if you are between four and twelve months delinquent on your payments and will now be able to make your full mortgage payments.
This fund is for those who may have fallen behind due to a temporary situation, are now able to make current payments but can't afford to pay off arrears.
4. Apply for assistance with the various government agencies. There are many people dealing with foreclosure. All levels of government recognize the immense problem, so a number of programs have been put in place to assist.
These include President Obama's Mortgage Modification Program and Project Lifeline. Some programs are designed to be used for a short period of time. Others offer a more permanent fix if you qualify. HUD is also a good resource to contact for assistance.
5. A last resort strategy might be to file suit in court against your creditors. With the huge backlog of cases on the docket, this may take off some of the pressure and allow you to sort things out while waiting for your case to be heard. Don't do this without consulting a real estate savvy attorney first to make sure it will work.
To stop foreclosure fast there is no doubt that you will need to be prepared to take action as soon as you receive the notice. Don't put off taking action hoping the foreclosure will go away. It won't and by the time you realize that fact, it may be too late.
